Blackburne J in Stanstell Ltd v Co-operative Group (CWS) Ltd  (2005)
Since the second edition of the Handbook of Co-operative and Community Benefit Society Law was published in September 2014, a number of developments have made an update necessary. In November 2015 the Financial Conduct Authority (FCA published its long-awaited Finalised guidance 15/12, Guidance on the FCA's registration function under the Co-operative and Community Benefit Societies Act 2014 ('FCA Guidance 2015'). This is central to the registration process for societies, the Guidance is discussed at some length in this supplement as relevant to particular sections of the Handbook. The text can be read as a stand-alone commentary on the Guidance. Other updates in the Supplement deal with later developments in case law and statute. The opportunity has also been taken to correct some minor errors and omissions that slipped through the proof reading of the original manuscript of the Handbook. This updating Supplement is organised by reference to the chapters of the Handbook. Within the Supplement, all the updating notes for a chapter are gathered under the heading for that chapter. Individual items are then organised by paragraph or subparagraph number within that part of the updating Supplement. It may be possible to read text as stand-alone commentary on the FCA's Guidance but, to make best use of this updating Supplement, readers should consult it alongside their copy of the Handbook.
